CANEY CREEK RV RESORT LEASE AGREEMENT

Caney Creek Resorts, LLC, (dba; Caney Creek RV Resort), (Lessor), hereby agrees to lease to ., Driver’s License # , SS #   (Lessee and RV owner), subject to all of the terms, and conditions of this agreement herein, one RV site at Caney Creek RV Resort (hereinafter Resort), for the following described RV; Length:   ft., Width:   ft., Type:  , # of Slides:  , Model:  , Year:  , VIN # , RV License Plate State:  , RV License Plate Number: . Term. The term shall commence upon and expire on . At expiration of this term, lease shall terminate upon 12:00 Noon on day of checkout. Removal of any RV from the premises shall not terminate this agreement or any other obligation hereunder. This lease agreement may not be subleased or assigned. Lessor has the absolute right to cancel this lease at any time and for any reason by providing 30 days notice to Lessee. Upon lease termination per terms herein, Lessee hereby agrees to promptly remove RV from the premises. Any holdover without written permission shall incur, and lessee agrees to pay, double the daily rental rack rate until removed and may result in the towing and removal of RV at the Lessee’s expense. This lease does not automatically renew. Lessee agrees to use the premises for part-time vacation and recreational use only, and Lessee may not use the premises as a residence (permanent or otherwise) under any circumstances. For security reasons, no mail will be accepted for guests.

Rent. Excepting published rental rate changes, Lessee agrees to pay a monthly lease payment of $ due and payable in advance on the 1st day of each month. Any payment not received by the 10th day of the month due, may result in a late charge of $20.00. If rental or other payment due is not received within 30 days of due date, it may subject the owner’s RV to being removed, secured or sold per Tennessee Code. For automated billing, Lessee hereby permits the Lessor to charge the rental due to the credit card listed as VISA/MC/AMEX/DISC No. , Exp. Date  . If credit card information is filled in you authorize Caney Creek to automatically debit your credit card for rent & balance due each month. A security deposit of $ is hereby acknowledged as paid and will be returned upon final payment of all amounts due at the end of lease. Breech of this agreement will result in loss of security deposit. There will be a $35.00 NSF fee for each returned check from the bank.

Insurance. Lessor requires, and Lessee agrees to carry RV general damage liability insurance, with Caney Creek RV Resort listed as additionally insured, with a minimum coverage per incident or $300,000 while RV is parked at the Resort. (Within this document, “Resort” is defined as; all property, owned, leased, or controlled by Lessee and area within the “harbor limits: as shown on TVA maps). Lessee shall furnish certificate of insurance within 15 days of this lease commencement and remain in force during the entire lease period; or at the sole option of Lessor, this lease shall become null and void. Lessee shall forever protect, hold harmless, and indemnify Lessor against all claims or liabilities of any kind caused by, or to the owner, owners RV or other property, including personal injuries, death, or the loss, damage or theft, or other property that arises directly or indirectly from the use or storage of RV(s) or other property at the Resort, including those caused unintentionally by Lessor, unauthorized users; acts of God, wind, rain, ice, snow, freezing conditions, lake fluctuations, wake, fire, or resultant infrastructure failure; acts or omissions of Lessee, his agents, employees, other lessees, or any other cause (excepting international misconduct), while being stored or moved within the Resort. Lessee authorizes lessor, its agents or employees the right, but not the obligation to move Lessee’s RV for safety, environmental or other Resort operations. Lessor does not carry insurance covering the property of the lessee. Lessees park at their own risk!

Discharge. Sewer connections are provided for all RV’s at every site. There are no “Dump” facilities. It is contrary to local, State, and Federal laws to discharge any chemical, household gray water, or sanitary waste (treated or untreated) anywhere except into the approved sewer system. Lessee agrees to abide by, and have his RV adhere to, all Federal, State, local, TWRA, TVA, and Corp of Engineers laws, regulations, rules, statutes, regulations and requirements. Lessor shall have the right, but not the obligation, to inspect all RV’s at the Resort to determine compliance with the above requirements or RV’s mechanical status. Lessee agrees to remove his RV immediately from the Resort at his own expense, if found by Lessor to be in violation of any of the above laws, or otherwise in an unsafe, non drivable condition and to indemnify Lessor for any liability or fines incurred because of such violations. All sewer connections must have a sewer ring and support for the sewer hose to allow proper gravity drainage.

Terms. Lessee(s) agree that they and their guest(s) shall at all times agree to and will adhere to the following while within the Resort, harbor limits, premises, or close proximity of the Resort. Lessee’s violation of the articles below shall allow Lessor to terminate this lease with 30 days notice; and where health, safety, disorderly behavior, water quality, or regulatory issues are concerned; allow Lessee to request Lessee’s immediate removal from the Resort, and Lessee hereby agrees to comply with such request.

  1. No RV shall be repaired, or cleaned with non-approved chemicals. No mechanic craftsman, or other person shall be allowed at the Resort without prior approval of Lessor for each visit; each showing evidence of adequate General Liability and Workmen’s Comprehensive Insurance coverage. Gasoline Cans are not allowed on docks. Generator use prohibited within Resort.
  2. Lessee shall not leave any rubbish, articles, or supplies of any kind on the RV sites or walkways serving docks.
  3. RV’s and vehicles must be in kept in good working condition with NO LEAKS of any kind. RV’s may be prohibited from entering the Resort if found to be in non-compliance of, mechanical, health, or safety codes. No repair work is to be done on site.
  4. Pets must be attended and leashed (6-foot maximum) at all times. You must clean up after your pet anywhere on the premises. Pets may be prohibited as necessary. Copy of current vaccinations must be kept on file in the office.
  5. Only one (1) RV and (1) vehicle shall reside in designated site unless otherwise approved by Lessor for an extra charge. Lessee shall not modify or add to site in any manner without written consent from Lessor. DO NOT park in any other site but your own. No ATV’s. Must be at least 16 years old to drive Golf Carts and all carts must have headlights to be driven at night.
  6. No auto/RV covers of any kind may be placed over units while parked within the Resort.
  7. Within the harbor limits no swimming, skiing, or diving allowed in these areas. NO WAKE within 300 feet of docks and shore.
  8. Fireworks or firearms are not permitted and shall not be displayed or discharged at the Resort.
  9. Lessees and their guests shall not engage in any disorderly behavior including, but not limited to profane language, slander, liable, harassment of employees or guests, disturbing the peace; and will not create annoying noise, or smells within the Resort at any time. Lessor retains the right to regulate annoying activity at the Resort. A state of general quietness shall be observed between the hours of 11:00pm and 7:00am.
  10. Site assignment or parking arrangements may change remaining the prerogative of the Lessor throughout term of this lease, for safety and the overall efficiency of operation; however we will attempt to accommodate Lessee’s desires when possible. Overnight parking of extra vehicle at Resort requires notification to, and written permission of, Lessor. Unidentified, unauthorized or misparked vehicles will be subject to surcharge or towing at the vehicle owners expense. Parking Pass required. Park only in your assigned space and please stay off the grass.
  11. In the event that a mechanical defect or emergency places the property of the lessee or any other lessee’s property in danger, lessee grants Lessor the right, but not the responsibility, to take such action as Lessor, in its sole discretion, deems necessary to safeguard any property located within the Resort. Lessee agrees to pay Lessor for any and all reasonable expenses, which Lessor incurred on behalf of lessee. Lessee MUST be able to move own RV out of the resort within 24 hour notice and immediately during emergencies.
  12. Resort is not responsible for winter damage to your RV. You are financially responsible for damage to the Resort’s water system if you do not disconnect your RV from the Resort’s water system. Winterization is a must from November –March. Winter skirting or underpinning must be pre-approved in writing by the Resort manager and must be neat in appearance.
  13. Lessee shall pay as additional rent, any separately metered electrical service and water. Surcharges may be charged for certain services, utilities, or multi-vehicle parking at discretion of Lessor.
  14. Waste receptacle is for tenant’s normal household type garbage only. No Fish Waste. Chemical, engine parts, and debris shall be removed from the premises by the owner or his contractor. Mechanics that spill or leave used oils or other waste on Resort site will be denied future access to the Resort. There will be no leniency regarding this provision!
  15. The opening or discharge within the Resort of any regulated materials, paints, thinners, solvents, waste, sewage, or petroleum products of any type or in any amount, and all other activity negatively impacting water quality is prohibited!
  16. No “For sale” signs, advertising, soliciting, business operation will be allowed on Resort property. For security reasons, known Brokers or RV owner shall accompany any prospective purchaser in Resort to view RV.
  17. Mowing Days: Lessee agrees to keep all personal items off the grass and pull in slides. If the mowers can’t reach under your rig you are responsible for mowing and maintaining that area. Additional fees may apply for violation of this rule. We are not responsible for damages to items left on the ground, including sewer lines and water hoses.
  18. In the event of any breach of this agreement by lessee, lessee agrees to pay for any and all legal costs, including attorney fees, for Lessor to collect money due from lease. Also, the lessee agrees to pay any and all reasonable expenses itemized by the Lessor, as a result of damage or injury to any property or personnel of the Lessor, and other individuals on or about the Lessor’s premises for which the Lessor might be liable, including any and all reasonable investigation and legal expense incurred by the Lessor as a result of lessee’s or it’s guests activities; and to pay attorney fees incurred by the lessee’s refusal to pay such itemized expenses after written demand by the Lessor.
  19. For emergency purposes, a spare key will be maintained at Resort office and will be returned at termination of the lease.
  20. Additional Resort policies on line at www.caneycreekrvresort.com and at the Resort office and are part of the agreement and all “addendum to lease” paperwork is included as a part of the agreement.

These policies and conditions may be amended from time to time as deemed desirable by the Lessor; or as necessary for compliance with pertinent laws, regulations, ordinances; or the safe and efficient operation of the Resort.
